2. Acceptance of these Terms

By creating an account or using the tubestat service available at tubestat.co (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Service.

3. The Service

The Service provides programmatic access to publicly available information about YouTube channels, videos, comments and community posts via a REST API. We do not host, own or control any of the underlying content; we surface data points that are already publicly visible on YouTube.

The Service is provided on a prepaid credit basis. Each successful API request consumes one or more credits, as published in our documentation. Credits do not expire.

4. Accounts

You must provide an accurate email address and choose a sufficiently strong password. You are responsible for all activity that occurs under your account, including any use of your API keys. Keep your credentials confidential and notify us immediately at [email protected] if you suspect unauthorized access.

You must be at least 16 years old (or the age of digital consent in your country) to use the Service. The Service is intended for business and developer use; you confirm that you have authority to bind any organisation you represent.

5. Credits, payment and pricing

Credits are purchased in advance through a secure third-party payment processor. We do not store full payment card details on our systems. All prices are in US dollars unless stated otherwise and are exclusive of any applicable taxes, which you are responsible for.

We may change our pricing for future purchases at any time by updating the pricing page. Credits already purchased are honoured at the rate in effect at the time of purchase.

Refunds are governed by our Refund Policy.

6. Acceptable use

Your use of the Service must comply with our Acceptable Use Policy. Material breach of that policy may result in suspension or termination of your account without refund of unused credits.

7. Intellectual property

The Service, including our software, branding, documentation and the structure and presentation of API responses, is owned by Luersoft Digital Services LTD and its licensors. We grant you a limited, non-exclusive, non-transferable licence to use the Service for your own internal or commercial purposes, subject to these Terms.

You may not resell raw API responses as a substantially equivalent competing service, nor sublicense access to the Service to third parties.

8. Third-party data

The Service surfaces information originating from YouTube and its publishers. We do not warrant the accuracy, completeness, freshness or availability of that data, and your use of it must comply with YouTube's own terms and any applicable laws.

9. Disclaimers

The Service is provided on an "as is" and "as available" basis. To the maximum extent permitted by law we disclaim all warranties, express or implied, including any implied warranties of merchantability, fitness for a particular purpose and non-infringement.

Nothing in these Terms limits any rights you may have as a consumer under applicable mandatory law that cannot be excluded by contract.

10. Limitation of liability

To the maximum extent permitted by law, our total aggregate liability arising out of or in connection with the Service in any twelve-month period shall not exceed the amount you paid us for the Service in that period. We are not liable for any indirect, incidental, special or consequential loss, including loss of profits, revenue, data or goodwill.

Nothing in these Terms excludes liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be excluded under English law.

11. Indemnity

You agree to indemnify and hold us harmless from any third-party claim arising out of your use of the Service in breach of these Terms or any applicable law.

12. Suspension and termination

You may close your account at any time. We may suspend or terminate access immediately if we reasonably believe you are in material breach of these Terms or the Acceptable Use Policy, or if required to do so by law. On termination, unused credits associated with the breach are forfeited.

13. Changes to the Service or these Terms

We may modify the Service or these Terms from time to time. Material changes will be announced via the Service or by email at least 14 days before they take effect. Continued use of the Service after the effective date constitutes acceptance.

14. Governing law and jurisdiction

These Terms are governed by the laws of England & Wales. The parties submit to the exclusive jurisdiction of the courts of England, without prejudice to any consumer rights you may have to bring proceedings in your country of residence.
